Throughout these Terms of Service, the terms “A Villagers Wonderland”, “we”, “our” and “us” refer to Harmony Imports Pty Ltd trading as A Villagers Wonderland.

These Terms govern your access to and use of our website, products and services. By visiting our website, creating an account or purchasing products from us, you agree to be bound by these Terms of Service. If you do not agree with these Terms, you should not use this website or purchase products through it.

Eligibility

By using this website, you confirm that you are at least 18 years old, or that you have the permission and supervision of a parent or legal guardian. You must provide accurate, complete and current information when placing an order or creating an account.

Products and Product Information

We make reasonable efforts to display product descriptions, colours, dimensions, images and specifications as accurately as possible. However:

·    colours may appear differently depending on your screen or device;

·    product packaging may change without notice;

·    dimensions may vary slightly;

·    handmade or hand-painted products may have minor variations in colour, finish, texture, alignment or decoration; and

·    product images may include display items, scenery or accessories that are not included unless expressly stated in the product description.

Many Lemax and collectable village products are individually painted and manufactured. Minor variations are part of their individual character and are not necessarily product faults. Nothing in this section limits your rights under the Australian Consumer Law.

Availability

All products are subject to availability. Adding a product to your cart does not reserve it. A product is not secured until payment has been completed and your order has been accepted.

We may limit quantities available for purchase where reasonably necessary, including where stock is limited, an order appears to be for resale, a pricing or inventory error has occurred, or we reasonably suspect fraudulent or unauthorised activity.

Orders

When you place an order, you are making an offer to purchase the selected products. Your order is not accepted until we receive or authorise payment and send you an order confirmation or otherwise begin processing the order.

We reserve the right to decline or cancel an order for a legitimate reason, including product unavailability, an obvious pricing or description error, payment not being authorised, suspected fraud or unauthorised activity, delivery being unavailable to the nominated address, or a breach of these Terms. If we cancel an order after payment has been received, we will refund the amount paid for the cancelled item or order.

Pricing

All prices are displayed in Australian dollars unless otherwise stated. Prices include GST where applicable. Delivery charges and any other applicable fees will be shown before checkout.

We may change prices at any time. A price change will not affect an order that we have already accepted, except where there has been an obvious pricing error.

Pricing Errors

We take reasonable care to ensure pricing is accurate. If a product is listed at an obviously incorrect price due to a typographical, technical or administrative error, we may contact you before processing the order. You may choose to proceed at the correct price or cancel the affected item and receive a refund of any amount already paid for it. We will not charge a higher corrected price without your agreement.

Payment

Payment must be made using one of the payment methods offered at checkout. By providing payment details, you confirm that you are authorised to use the selected payment method, the information supplied is accurate, and sufficient funds or credit are available.

Payments may be processed by third-party payment providers. Their separate terms and privacy practices may also apply. We do not guarantee that every payment method will always be available.

Pre-Orders and Special Orders

A pre-order is an order for a product that is not yet available for immediate delivery. Estimated arrival and release dates are guides only and may change due to manufacturing, shipping, customs or supplier delays outside our reasonable control. We will provide updates where reasonably practicable if a significant delay occurs.

Special-order products are sourced specifically at the customer’s request. Deposits for pre-orders and special orders may be non-refundable for change-of-mind cancellations where this is clearly disclosed before purchase. This does not affect rights available under the Australian Consumer Law. If we cannot supply a pre-ordered or special-order product, we will provide an appropriate refund.

Gift Cards

Gift cards may be used only in accordance with the conditions stated when issued, cannot generally be exchanged for cash, must not be resold or used unlawfully, and are not refundable for change of mind. Nothing in this section limits rights that cannot lawfully be excluded.

Shipping and Delivery

Shipping times provided on our website are estimates only unless we expressly agree otherwise. Delivery may be affected by matters outside our reasonable control, including carrier delays, severe weather, peak seasonal demand, industrial action, customs processing or natural disasters.

Customers are responsible for providing a complete and accurate delivery address. We are not responsible for delays caused by incorrect or incomplete information supplied by the customer.

Where an order is returned to us because an incorrect address was provided, delivery was refused, the parcel was not collected, or the carrier could not complete delivery due to customer-related circumstances, the customer may be required to pay reasonable additional delivery costs before the parcel is resent.

Risk and Ownership

Ownership of products passes to you once we have received full payment. Risk in the products passes to you when the products are delivered to the nominated address or collected by you. This does not affect any rights you may have where products are lost or damaged during delivery.

Click and Collect

Where click and collect is offered, we will notify you when your order is ready. Please do not attend for collection until you have received confirmation. You may be asked to provide your order confirmation, identification and evidence that you are authorised to collect the order. Orders must be collected within the timeframe communicated to you.

Returns and Refunds

Returns, exchanges, damaged goods and refunds are governed by our separate Returns & Refunds Policy, which forms part of these Terms. Our Returns & Refunds Policy does not exclude or restrict any right or remedy available under the Australian Consumer Law.

Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You may be entitled to a repair, replacement, refund, cancellation or compensation where goods fail to meet an applicable consumer guarantee. Nothing in these Terms excludes, restricts or modifies any guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified.

Website Use

You may use this website only for lawful personal or business purposes connected with viewing or purchasing our products. You must not:

·    use the website for any unlawful or fraudulent purpose;

·    interfere with the security or operation of the website;

·    introduce viruses, malware or harmful code;

·    attempt to gain unauthorised access to our systems;

·    scrape, copy or extract website content through automated means without permission;

·    impersonate another person;

·    use the website to infringe another person’s rights; or

·    place fraudulent, speculative or unauthorised orders.

Accounts and Passwords

You are responsible for maintaining the confidentiality of your account details and password. You must notify us promptly if you suspect unauthorised use of your account. You are responsible for activities undertaken through your account unless the activity occurred because of our failure to take reasonable security precautions.

Intellectual Property

All content appearing on this website, including our logos, branding, graphics, photographs, product descriptions, website design and original written material, remains the property of Harmony Imports Pty Ltd trading as A Villagers Wonderland unless otherwise stated.

Product names, trademarks, logos and images belonging to manufacturers, including Lemax, remain the property of their respective owners and are used for identification and promotional purposes only.

You may view and print website content for personal, non-commercial use. You must not copy, reproduce, modify, distribute, publish, sell or commercially exploit our content without prior written permission, except where permitted by law.

Customer Content and Reviews

Where you submit a review, photograph, comment or other content, you confirm that you created it or have permission to submit it, it does not infringe another person’s rights, it is not unlawful, threatening, defamatory, obscene or misleading, and it does not contain malicious code or unauthorised advertising.

You grant us a non-exclusive, royalty-free licence to display, reproduce and use that content for operating and promoting our business. We may moderate or remove content where reasonably necessary, but we will not alter or suppress reviews in a way that creates a false or misleading impression.

You agree to compensate us for reasonable loss, damage or expense directly caused by your unlawful use of the website, your fraud, or your serious breach of these Terms. This clause does not require you to compensate us for loss caused by our own negligence, unlawful conduct or breach of these Terms.

Events Outside Our Reasonable Control

We will not be responsible for delay or failure caused by events outside our reasonable control, provided we take reasonable steps to reduce the effect of the event and resume performance as soon as reasonably practicable. This may include natural disasters, severe weather, fire or flood, war or civil disturbance, government restrictions, industrial action, transport disruption, telecommunications failure or major supply-chain interruption. This clause does not remove rights that cannot be excluded under law.

Changes to These Terms

We may update these Terms from time to time. The version applying to an order will generally be the version published when the order was placed. Any updated Terms will take effect when published on the website and will apply to future website use and future orders.

We will not retrospectively change an accepted order unless you agree, the change is required by law, or the change benefits you without imposing a disadvantage.

Entire Agreement

These Terms of Service, together with our Privacy Policy, Shipping Policy and Returns & Refunds Policy, constitute the entire agreement between you and A Villagers Wonderland regarding your use of this website and your purchase of products from us.

Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be read down or removed only to the extent necessary. The remaining provisions will continue to apply.

No Waiver

If we do not immediately enforce a right under these Terms, this does not mean we have waived that right.

Governing Law

These Terms are governed by the laws of Western Australia and the Commonwealth of Australia. You and A Villagers Wonderland submit to the courts and tribunals having jurisdiction in Western Australia, subject to any rights you may have to bring a claim in another jurisdiction under applicable consumer law.
